Legislative Decree 30/2026 - From 27 September 2026, undocumented green claims become illegal in Italy.
Legislative Decree No. 30 of 20 February 2026, published in the Official Gazette on 9 March 2026, implements EU Directive 2024/825 "Empowering Consumers for the Green Transition" and amends the Italian Consumer Code.
The provisions enter into force on 27 September 2026.
What changes for companies.
The decree introduces an explicit ban on generic environmental claims — "green", "ecological", "environmentally friendly", "sustainable supply chain" — in the absence of measurable and verifiable evidence. Claims of neutral or positive impact based exclusively on emission compensation mechanisms, and sustainability labels not based on certification systems recognized by public authorities, are also prohibited.
Violations constitute unfair commercial practices pursuant to the Consumer Code, with the related sanctioning consequences.
Specific case of textiles: the certification of materials.
In the textile sector, the claims most exposed to the risk of non-compliance are those relating to certified materials — GRS for recyclates, OCS and GOTS for organic, RWS for wool, BCI for conventional cotton, and many others.
The problem is structural and common to all these certifications: the standards certify volumes in kilograms over periodic time windows. The European Regulation on the Digital Product Passport — and now Legislative Decree 30/2026 — instead require the verifiable declaration for each product garment.
